Separate Portal for disciplinary complaints to ICAI against CA

An E-mail was sent by ICAI president stating the importance of disciplinary action and launching a separate portal for filing Complaint against a CA. The website also showcases Code of ethics which a Chartered accountant should follow, other than this some more features of this website are: CODE OF ETHICS, CAUSE LIST, ORDERS, FILE COMPLAINT.

The E-mail of president included the following message:

“You all will agree that our robust disciplinary mechanism which derives strength from the provisions of the Chartered Accountants Act 1949 is the backbone of the profession and perhaps, the professional excellence which is associated with the professional work executed by us is an outcome of the same. Our disciplinary mechanism has primarily three limbs, the Director (Discipline), the Board of Discipline and the Disciplinary Committee. The Institute has always remained at the technological forefront and strives for harnessing technology for process automation and knowledge dissemination. Some of our recent technology driven initiatives like Unique Document Identification Number (UDIN), Digital Competency Maturity Model, and Digital Learning Hub are well recognised, used and acknowledged by members, students as well as various professional organisations in India and abroad.

Similarly a need has been felt for digitisation of disciplinary function. The digitisation of the entire disciplinary mechanism is a mammoth task in itself keeping in view of its voluminous and complex nature of work, however, we are pleased to share with you all that after successful implementation of E-hearing during this Council year, now we have taken one more small step in the direction of digitisation by developing a separate portal (https://disc.icai.org) specifically for disciplinary mechanism wherein all pertinent information is readily available like the procedure to file complaint (physically or through e-filing), Cause List, Orders passed by the Disciplinary Committee, Committee compositions, details of meeting(s), amongst others for the benefit of various stakeholders.”

There is also a provision to file complaint online through ‘ E-Form ‘I ‘.However, any complaint submitted online has mandatorily to be supplemented by taking a print out of the said E-form, signing the same and sending across in original along with the copy of the evidences in support of the allegations in triplicate to the “Director (Discipline), Disciplinary Directorate, The Institute of Chartered Accountants of India, ICAI Bhawan, Post Box No.7100, Indprastha Marg, New Delhi – 110 002.” In absence of above compliance, the online complaint shall not be treated as being filed.

Further, as per Rule 4, Complaint should be accompanied by a Total fee of Rs. 2,950/- (including 18% GST on Rs. 2,500/-) (Rupees Two thousand nine hundred fifty only).
