Representation made by many tax practitioner groups for extension of Income tax return and tax audit due date

As of Now the due date under Income tax are as under:

Due date- 31 December 2020:
Return of income for the assessment year 2020-21 for all assessee other than
(a) corporate-assessee or
(b) non-corporate assessee (whose books of account are required to be audited) or
(c) partner of a firm whose accounts are required to be audited or
(d) an assessee who is required to furnish a report under section 92E.

The due date for filing of tax audit report or any other report under Income tax is also 31.12.2020.

Due date- 01 January 2021:

All the exceptions mentioned above have to file their return of Income till 01.01.2021.

Various groups of Tax practitioner have raised various reason to extend the above due date:

1. ITR and Tax audit utility were released very late i.e. ITR utilities were updated again in December 2020.

The groups have even advised CBDT to release ITR utility till April month of next financial year so that returns can be prepared and filed in time.

2. In many states government has announced night curfew like Rajasthan, Gujarat, Madhya pradesh etc.

Thus, based on this and various other points these bodies have asked to extend due date of filing various reports upto 28.02.2021 for which current due date is 31.12.2020 and due date for Income tax return has been asked to be extended till 31.03.2021.
