Section 139 deals with the various conditions or situations under which a person is required to file income tax return which are mainly based on total income earned by an assessee. Also, there are various conditions prescribed under Income Tax Act wherein a person is required to file Income tax return irrespective of whether he has income or not.

Considering the above provisions now, Income tax department is sending notices to assessee who have not filed their return of income to file the Income tax return as the due date to file the same is 31.12.2022.

The message being received from Income tax department read as under:
“Attention XXXXX XXXXX (PAN XXXXX5560X)
Based on available information with Income Tax department, it appears that you were required to file ITR for A.Y. 2022-23 but have not filed yet. Please file your ITR or submit online response under e-Campaign tab on Compliance Portal. Access Compliance Portal after login to the e-filing Portal (https://www.incometax.gov.in), go to “Pending Actions” tab, click on “Compliance Portal” and select “e-Campaign (AY 2021-22 onwards)”. On Compliance Portal, under e-Campaign list, view campaign type ”Non-Filing of Return”. Please ignore if ITR has already been filed. – ITD”
Thus, based on the above notice Income tax department is requesting assessee to file income tax return because as per Income tax department that person is required to file income tax return.
This could be based on various reasons such as cash deposit in bank account, transactions in shares and securities on stock market, sale of property or purchase of property and thus it is advisable to check AIS and if required file Income tax return before due date.
