Filing of annual return for FY 2020-21 is optional for Aggregate Annual turnover upto Rs. 2 crore

In the previous notification i.e. notification no. 30/2021 we had seen that rules for GSTR 9 and GSTR 9C were introduced for FY 2020-21 along with relevant changes in the Form.

Further, in the 43rd GST council meeting it was proposed taxpayer’s with annual aggregate turnover (AATO) upto Rs. 2 crore exempt from filing of annual return for FY 2020-21.

However, the same was not mentioned in the rules announced and we had said that a notification shall be issued for same.

Now, CBIC has vide notification no. 31/2021 dt. 30.07.2021 has announced that taxpayer with AATO upto Rs. 2 crore are exempt from filing of Annual return for FY 2020-21.

The notification says as under:

In exercise of the powers conferred by the first proviso to section 44 of the Central Goods and Services Tax Act, 2017 (12 of 2017), the Commissioner, on the recommendations of the Council, hereby exempts the registered person whose aggregate turnover in the financial year 2020-21 is upto two crore rupees, from filing annual return for the said financial year.

This notification shall come into force from the 1st day of August, 2021.”
